1. Acceptance of the terms and conditions
1.1 The website, https://www.weaverbirds.com.au/ (“the website”) is owned and operated by Weaverbird Stories. Any references to “we”, “us” or “our” in these Terms and Conditions are in reference to Weaverbirds Pty Ltd.
1.2 Any references to “you” in these Terms and Conditions are in reference to the individual using the website and purchasing any products detailed on the website.
1.4 Your access to and use of Weaverbirds Pty Ltd is subject exclusively to these Terms and Conditions. By using the website and/or ordering any products available on the website, you signify that you have read, understood and agree to be bound by these Terms and Conditions.
1.5 These Terms and Conditions shall apply to all sales of the products by us via the website and shall supersede any other Terms and Conditions contained or referred to elsewhere or implied by trade, custom, practice or course of dealing unless specifically agreed to in writing by us.
1.6 You will not use the website for any purpose that is unlawful or prohibited by these Terms and Conditions.
2.1 Prices for our products are subject to change without notice and we reserve the right to change these prices at any time without notice to users.
2.2 We will endeavour to ensure that the prices are displayed correctly, however, there may be the rare occasion where a price is listed incorrectly. We will aim to rectify any such error as quickly as possible.
2.3 We are under no obligation to provide the product to you at the incorrect price if the pricing error is obvious and unmistakeable and could reasonably be recognised by you as a mis-pricing.
2.4 Prices are shown in AUD. The price of the product does not include the delivery charge.
3. Delivery and Acceptance
3.1 Products may be delivered globally
3.2 The place for delivery of products will be shown on the order and the normal method of delivery (unless stated otherwise) will be ordinary post.
3.3 If you have ordered more than one product, we reserve the right to make delivery of your order in instalments. If the order is made in instalments, each delivery will constitute a separate contract.
3.4 We will endeavour to process your order within the time period specified for each item. However, processing and manufacturing times may vary, and any times quoted for the delivery of goods are indicative only. Time for delivery shall not be of the essence of these Terms and Conditions and we will not be liable for any loss or expenses which you may sustain as a result of any delay in the delivery of your Order.
3.5 We will not be liable for any items missing, damaged or delayed during transit.
4.1 It is up to you to ensure that all content/personal information you provide on the website when making a purchase is correct.
4.2 If you receive your products damaged or the printing is faulty, you may request a refund or reprint. We will not refund you if the product(s) are in a good condition but the content is wrong due to a mistake made by you when ordering.
4.3 You can request a refund or reprint in the case of printing faults or damage on your order within 7 days of the date of receipt of the Product(s).
4.4 If you choose to receive a refund, we will refund you the total amount you paid for the product(s), within 14 days of the day on which you provide us with evidence that the product(s) are faulty.
4.5 If you choose to have your product(s) reprinted, we will do so for a fee specified.
5. Third party links
5.1 Third party links on this website may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of any content on third-party websites and we will not be liable or responsible for any third-party materials or websites, or for any other materials, products or services provided by third parties.
5.2 We will not be liable for any loss or damage which you may suffer from visiting, or purchasing products on any third-party websites.
7. Intellectual Property Rights
7.1 All material on our website is either owned by or licensed to Weaverbird Stories and cannot be redistributed or reproduced without prior permission. This material includes, but is not limited to; designs, photographs/images, text, layout, looks and graphics.
7.2 You may not copy, distribute or create any derivative work or commercially exploit any content from Weaverbirds Pty Ltd, or any of the material found on our Website without our prior express, written permission.
7.3 Unauthorised use of this website and the materials within it may give rise to a claim for damages.
8.1 Our liability for any losses you suffer as a result of us breaching this Contract is strictly limited to the purchase price of the product you purchased.
8.2 You expressly agree that your use of the website including website content is at your own risk.
8.3 You agree that we will not be liable for:

8.5 Any loss or corruption of data;
8.6 Any loss or damage which does not directly result from our failure to comply with this Agreement.
9.1 You agree to indemnify and hold Weaverbird Stories and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Weaverbird Stories arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this website.
10.1 We may remove the website or cease the provision of any of the services or products available through the website at any time in our sole discretion for any reason.
10.2 We may terminate your access to the website for any reason in our sole discretion at any time with or without notice.
11.1 If any of these Terms and Conditions should be deemed to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, then such Terms or Condition shall be severed, and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
12. Governing Law
12.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia.
13 Kids Helpline Referral Donations
13.1 We will endeavour to donate $3 to Kids Helpline for every unique and genuine referral through the Weaverbirds web referral form.
13.2 Referral donations payments will be made to Kids Helpline on a monthly basis and in the name of Weaverbird Stories.
13.3 Weaverbirds Stories is under no obligation to make these donations.
